The customer is responsible for providing a complete and correct delivery address.
If a shipment is returned due to:

\u2022 non-collection
\u2022 refusal of delivery

the customer is responsible for the actual return costs and any re-delivery fees.<\/p>\n\n\n\n
5.4.
Risk passes to the customer once the shipment is handed over to the carrier.<\/p>\n\n\n\n

6.1.
For deliveries outside the European Union, the customer is responsible for all applicable:

\u2022 import taxes
\u2022 brokerage fees

These costs are not included in the product or shipping price unless explicitly stated otherwise.<\/p>\n\n\n\n

We are not responsible for delays caused by customs procedures.<\/p>\n\n\n\n

Customers within the EU may withdraw from the purchase within 14 days of receiving the product, in accordance with EU consumer law, unless an exemption applies.<\/p>\n\n\n\n

Returned items must be:

\u2022 uninstalled
\u2022 in original packaging
\u2022 in resaleable condition<\/p>\n\n\n\n
7.3.
We do not accept returns of:
\u2022 items that have been installed, used, damaged or modified
\u2022 custom-made items
\u2022 special-order items
\u2022 clearance or discounted items (unless faulty)<\/p>\n\n\n\n
7.4.
The customer is responsible for return shipping costs unless the return is due to our error or a defective product.<\/p>\n\n\n\n
7.5.
Refunds are issued once the returned items have been inspected and approved.<\/p>\n\n\n\n

The customer is responsible for verifying compatibility with their specific vehicle before purchase.<\/p>\n\n\n\n
8.3.
We are not responsible for installation errors or incorrect assumptions regarding fitment.<\/p>\n\n\n\n

9.1.
Automotive parts should be installed by a qualified professional. Improper installation may cause damage or safety issues.<\/p>\n\n\n\n
9.2.
We are not liable for:
\u2022 damages resulting from improper installation
\u2022 incorrect use
\u2022 modification of the product
\u2022 use of products on public roads where the product is not road-legal
\u2022 vehicle malfunctions caused by aftermarket parts<\/p>\n\n\n\n
\u2e3b<\/p>\n\n\n\n
10.1.
Statutory warranty rights apply in accordance with EU and German law.<\/p>\n\n\n\n
10.2.
Many products we sell (including BMW OEM parts and third-party brands) are covered by the manufacturer\u2019s warranty.
In such cases, the manufacturer \u2014 not PaddleShifterz PS UG \u2014 is responsible for assessing and fulfilling warranty claims.<\/p>\n\n\n\n
10.3.
For OEM and third-party branded products, we will assist you in forwarding your claim to the manufacturer, but we do not make warranty decisions, nor are we obligated to provide replacements directly unless required by statutory law.<\/p>\n\n\n\n
10.4.
The customer is responsible for complying with the manufacturer\u2019s warranty conditions, which may include:
\u2022 providing proof of purchase
\u2022 providing installation documentation
\u2022 ensuring installation was performed by a qualified professional
\u2022 returning the defective part for inspection
\u2022 adhering to vehicle-specific or usage limitations<\/p>\n\n\n\n
10.5.
Warranty does not cover defects or damage caused by:
\u2022 improper installation or handling
\u2022 incorrect use or misuse
\u2022 lack of maintenance
\u2022 modifications or alterations
\u2022 use of the product outside its intended purpose
\u2022 use of the product in an officially – by manufacturer – not supported vehicle
\u2022 normal wear and tear
\u2022 damage caused by third-party components
\u2022 improper storage or environmental factors<\/p>\n\n\n\n
10.6.
If a defect is confirmed within the statutory warranty period, we will \u2014 at our discretion and in accordance with German law \u2014 either:
\u2022 repair the product,
\u2022 replace it, or
\u2022 issue a refund.<\/p>\n\n\n\n
In the case of manufacturer warranties, the manufacturer\u2019s decision is final and determines whether repair, replacement or denial applies.<\/p>\n\n\n\n
10.7.
Warranty claims cannot be processed for products that have been installed, used, or modified in a way that violates the manufacturer\u2019s instructions or affects the ability to verify the defect.<\/p>\n\n\n\n

11.1.
Our liability is limited to intent and gross negligence.<\/p>\n\n\n\n
11.2.
We are not liable for indirect, incidental, or consequential damages.<\/p>\n\n\n\n
11.3.
Nothing in these Terms excludes liability for death or personal injury caused by negligence.<\/p>\n\n\n\n

Goods remain the property of PaddleShifterz PS UG until full payment has been received.<\/p>\n\n\n\n
