  1. Scope

These Terms & Conditions (“Terms”) apply to all purchases made through paddleshifterz.com and to all agreements between PaddleShifterz PS UG (haftungsbeschränkt) (“we”, “us”, “our”) and the customer (“you”, “your”).
By placing an order, you accept these Terms in full.

  1. Contract Formation

2.1.
All product listings, prices and shipping information on our website are non-binding.

2.2.
Your order constitutes an offer to purchase.
An order confirmation e-mail merely acknowledges receipt of the order and does not constitute acceptance of the contract.

2.3.
A purchase contract is only concluded when the goods have been dispatched and you receive a shipping confirmation.

2.4.
We reserve the right to refuse or cancel any order prior to shipment.

  1. Right to Cancel in Case of Errors (Pricing, Shipping Costs, Technical Issues)

3.1.
We make every effort to ensure accurate pricing, product information, availability, and shipping costs.
However, in the event of an obvious error, including but not limited to:
• technical or system errors
• typographical mistakes
• incorrect pricing
• incorrect shipping-cost calculation
• incorrect discount application

we reserve the right to cancel the order, even after an order confirmation has been issued.

3.2.
In such cases, you will be informed without undue delay and receive a full refund of any payments made.
No further claims may arise from such cancellations.

4.1.
All prices are displayed in the currency selected on our website and include VAT where applicable.

4.2.
Payment methods available at checkout may vary depending on country, payment provider or fraud-protection measures.

4.3.
We reserve the right to cancel orders if payment authorization is refused or fraudulent activity is suspected.

  1. Shipping & Delivery

5.1.
Delivery times shown on our website are estimates only.

5.2.
We are not responsible for delays caused by third-party carriers, customs processing, strikes, natural disasters, or other circumstances outside our control.

5.3.
The customer is responsible for providing a complete and correct delivery address.
If a shipment is returned due to:
• incorrect address
• non-collection
• refusal of delivery
• failure to pay customs/import duties

the customer is responsible for the actual return costs and any re-delivery fees.

5.4.
Risk passes to the customer once the shipment is handed over to the carrier.

  1. Customs, Duties & Import Fees

6.1.
For deliveries outside the European Union, the customer is responsible for all applicable:
• customs duties
• import taxes
• brokerage fees
• customs clearance charges
• local VAT

6.2.
These costs are not included in the product or shipping price unless explicitly stated otherwise.

6.3.
We are not responsible for delays caused by customs procedures.

  1. Returns & Refunds

7.1.
Customers within the EU may withdraw from the purchase within 14 days of receiving the product, in accordance with EU consumer law, unless an exemption applies.

7.2.
Returned items must be:
• unused
• uninstalled
• in original packaging
• in resaleable condition

7.3.
We do not accept returns of:
• items that have been installed, used, damaged or modified
• custom-made items
• special-order items
• clearance or discounted items (unless faulty)

7.4.
The customer is responsible for return shipping costs unless the return is due to our error or a defective product.

7.5.
Refunds are issued once the returned items have been inspected and approved.

  1. Product Fitment & Compatibility

8.1.
Fitment information (vehicle model, generation, year, engine, etc.) is provided to the best of our knowledge.

8.2.
The customer is responsible for verifying compatibility with their specific vehicle before purchase.

8.3.
We are not responsible for installation errors or incorrect assumptions regarding fitment.

  1. Installation & Use of Products

9.1.
Automotive parts should be installed by a qualified professional. Improper installation may cause damage or safety issues.

9.2.
We are not liable for:
• damages resulting from improper installation
• incorrect use
• modification of the product
• use of products on public roads where the product is not road-legal
• vehicle malfunctions caused by aftermarket parts

  1. Warranty & Defects

10.1.
Statutory warranty rights apply in accordance with EU and German law.

10.2.
Many products we sell (including BMW OEM parts and third-party brands) are covered by the manufacturer’s warranty.
In such cases, the manufacturer — not PaddleShifterz PS UG — is responsible for assessing and fulfilling warranty claims.

10.3.
For OEM and third-party branded products, we will assist you in forwarding your claim to the manufacturer, but we do not make warranty decisions, nor are we obligated to provide replacements directly unless required by statutory law.

10.4.
The customer is responsible for complying with the manufacturer’s warranty conditions, which may include:
• providing proof of purchase
• providing installation documentation
• ensuring installation was performed by a qualified professional
• returning the defective part for inspection
• adhering to vehicle-specific or usage limitations

10.5.
Warranty does not cover defects or damage caused by:
• improper installation or handling
• incorrect use or misuse
• lack of maintenance
• modifications or alterations
• use of the product outside its intended purpose
• use of the product in an officially – by manufacturer – not supported vehicle
• normal wear and tear
• damage caused by third-party components
• improper storage or environmental factors

10.6.
If a defect is confirmed within the statutory warranty period, we will — at our discretion and in accordance with German law — either:
• repair the product,
• replace it, or
• issue a refund.

In the case of manufacturer warranties, the manufacturer’s decision is final and determines whether repair, replacement or denial applies.

10.7.
Warranty claims cannot be processed for products that have been installed, used, or modified in a way that violates the manufacturer’s instructions or affects the ability to verify the defect.

  1. Limitation of Liability

11.1.
Our liability is limited to intent and gross negligence.

11.2.
We are not liable for indirect, incidental, or consequential damages.

11.3.
Nothing in these Terms excludes liability for death or personal injury caused by negligence.

Goods remain the property of PaddleShifterz PS UG until full payment has been received.
